It appears that the good judge is giving himself an out here. He is unquestionably headed up the same blind alley as he did in the past trial i.e. designing software from the bench so he has taken a recent historical development to give himself a graceful way to dismiss this case with a few harsh words deploring MSFT's aggressive marketing tactics which appear to be endemic throughout the industry.
