Well, its my understanding that there is two types of insider trading. The first is the outsider who upon hearing sensitive information before its announced to the public, trades on this information, committing an illegal act. The second type is the employee of company xyz buys shares in company xyz because he is aware of information that the public does not currently have. This second type applies mainly too officers & directors of firm xyz, so if the stock boy of xyz buys shares in xyz sec will not consider this insider trading because he is not privy to sensitive data.
