I don't think so. First of all, do you have a multimillion dollar tester and can you demonstrate that both devices behave identically? I don't think so. Second, you are paying for what is guaranteed. Can you demonstrate the running a few apps in Win98 exercises enough speed paths and potential fault nodes to be meaningful? I don't think so. Can you guarantee that both parts meet all the specifications published in the data sheet? That's what is being guaranteed when you buy the higher speed part. Needless to say, if there was an attorney out there who could prove it in court, it would have been done long ago.
