Hey all-

I've read the S-3 and thought it through. Let's think about it shall we? What is Lev supposed to say..."we shipped batteries to OEM for testing?" On the surface you would say yes, he should. BUT...

How can he get in trouble if he says this? Well, suppose an OEM tests the battery and it works fine, but it needs a shape change (or something minor) that will cause a one month delay. Does Lev have to report that to us also? If he does, the stock tanks.

So, why say anything. Just because the S-3 says they didn't ship to OEM's does it mean they haven't? By saying that and surprising us with an OEM order in the near future...is that illegal. Have you ever heard of a company getting sued for hiding good news and the stock rose unexpectedly? Can you sue a company for that? I am sure you can...but what seems more logical?

My take is Lev et al are playing it very close to the vest. Those in the know probably don't give a hoot at the stock price right now. They have a business to run and I think the S-3's message is clearly "we aren't saying anything and in that way we can't get in trouble."

It's my opinion...like it or not. I think the goods are still there and time will prove me out (hopefully).

A 20%+ bounce...let's see if she'll hold over the next few days.
