Furthermore, ATHM's cable contracts exclude them from streaming media beyond 10 min. clips both in an effort to not strain cable plant and to not directly compete with traditional video services.

That's not what ATHM told me.

I asked them directly about this and they said that the restriction only applies to ATHM as an ISP. In other words, ATHM itself is not allowed to stream more than 10 minutes.

I asked them if I can listen to a 2 hour stream originating from Joe's ISP and coming over @Home. ATHM said:

Of course, it would be crazy to think that we are going to cut off transmission by anybody streaming over 10 minutes. You can do that right now.

I asked how this misconception got out into the public. He said extremist and newspapers trying to shock people.

You also failed to mention that the 10 minute streaming clause, which is fairly meaningless, is not in all contracts. You boldly state: ATHM's cable contracts . I can't remember for sure but I think ATHM told me that this clause was only in the TCI contract.

Left unsaid, of course, is the fact that you can change any contract by mutual consent. Suppose some big company buys TCI. There can be a lot of contract changes in a short period of time.
