Cindy and Group,
I would like to offer a counterpoint to Cindy's experience regarding arbitration. I worked automotive arbitrations for 4 years for a major
automotive manufacturer and can state, without reserve, that this forum of dispute resolution was stacked in favor of the consumer (as it should be). So why is my opinion different than Cindy's? I think the following observations apply:
1) Automotive arbitrators were trained community volunteers, not attorneys ('nuff said)
2) Decisions in automotive arbitration were binding on the manufacturer but not the consumer (if the consumer accepted the decision) In other words, if the customer got a favorable decision in arbitration he could accept it. If he got a decision he didn't like, he was free to reject it and pursue other means such as small claims, etc.
I think the lesson to be learned is that different arbitration programs have different parameters. Make sure you know the rules before you sign up!
