Unfortunately, I dont think he has a case for arbitration. It simply seems like a poor execution. Its a negotiated market without a singular exchange thus the excuses could be "stock ahead" or no bids.

8 minutes seems like a long time to not get anything off. I could understand it taking a few moments to complete the 3k piece, but 8 minutes to get nothing other than the low of the run...sounds like a poor execution or they made a market in the stock...

have them call the broker, bitch a little about the fill...ask them if they make amarket in the stock, who they did the trade against, what time the trade was entered into an electronic system, or shown to a market maker..those are the right steps...
