If they price it too high no one will exercise, and the Germans will be stuck buying the stock at a high price. Actually, I am surprised they didn't price it much lower to begin with, in the $4-5 range, assuring that all rights would be exercised. To me, the fact that they chose a higher exercise price indicates that they wouldn't mind buying some additional shares.
