Just imagine for a moment, actually trying to prove that allegation. You can't have a copyright on a ex employees brain. Now on the other hand if they could prove industrial espionage (ie. Hire a guy and tell him you gonna give him a big fat bonus if he brings a few key documents over to the new firm.) that is entirely different but very very hard to prove.
