It is tempting to use your reasoning to justify your point, but the question is, who's to say that there's a 50% chance these stocks will go up in a year? What if there was only a 49% chance? What about 90%? Some people might make your argument and substitute your 50% for 100%. The certainty level on which you seem to place so strong an emphasis is completely relative.

The principle is the same regardless of 'quantative scale': Money not won was never yours to begin with regardless of how certain you are that you would have been able to make that money. (ie. a person finds $1000 in a bag on the street. Although he is 100% certain that he could keep it without repercussion, his honesty compels him to return the bag. Did he just lose $1000?)

Assuming that you did not pick the very best stock at the best possible time, do you consider yourself to be abig loser in the stock market?

BTW, not that I care for them, but the IRS does not agree with you.
