Today's Wall Street Journal has an article about the trial. Apparently Judge Jackson is not satisfied with being a judge, he is now introducing his own evidence.He introduced a column from the opinion page of the Washington Post where the writer claimed that the president of AOL said he wouldn't compete with MSFT in the operating systems area. This is third hand evidence, hearsay, with none of the participants under oath. I can't remember hearing about a case with such an apparently biased judge. If he rules against MSFT he has given them plenty of ammunition for appeal. OTOH, it is remotely possible that the judge is subtle enough to establish his judicial reputation by appearing to be biased and then delivering a verdict in favor of MSFT. In any case I suspect he made up his mind long ago.
