To anyone interested:

I am going to tentatively begin a shareholders movement which will also seek to garner institutional support regarding the direction of Vivus.

If Leland Wilson is unable to ink a deal to market MUSE domestically by the next conference call then the tentative plan will be to proceed at full speed. This will occur even if he manages to sign a partner after this date. Enough is enough already! I don't care to hear any more excuses from Wilson or Vivus IR. The goals will be to institute the following changes to be voted upon by the next annual share holders meeting:

1)Replace Leland Wilson with a competent CEO.
2)Recruit new competent board members with at least one board member who works for Astra and another who works for JNJ. We also need a board member who has some sort of experience in pharmaceutical marketing and someone with past experience as it relates to a public company's ability to gain institutional support. There is no credibility in current Vivus management (exception is current CFO).
3)Vivus needs effective IR and PR management. We need to find someone who is in tune to current share holder needs and has the ability to attract new share holders.

I have never led such a cause in the past but feel that my anger is best channeled into constructive change.

I have currently set some tentative rules for who should be involved.

1)I am primarily interested mostly in getting the vote of as many shares as possible. This being the case, I do not want to keep tabs on every Tom Dick and Harry who owns this stock. Therefore, minimal ownership is 1000 shares.

2)I do not want to include anyone who recently bought Vivus stock and plans on selling their shares in a short time span (eg on the next pop to 4). Therefore, I wish to only include those who have a minimal target price to sell their shares at no less than $8.00/share. I picked this number because from prior communications, it appeared that most with rather large holdings needed somewhere between $8.00 and $9.00 just to break even. The reason I chose to make this rule is because it will be enough work to keep track of the shares and I don't want to depend on someone's shares as a vote that are going to end up being sold before the share holders meeting.

If things go as planned then I would also strongly consider forming a web site or chat room which would only have access to Vivus share holders who meet the above criteria.

I do not plan on doing all of this myself.

Anyone interested in helping me organize this sort of grass roots share holders movement to start change need only to send me a personal message.

Anyone who wishes to include their shares in the vote for change need only to send me a personal e-mail. Those who join the group will have eventual access to the list of investors who own Vivus stock. The list will include our names, number of shares owned, and e-mails(so any share holder can freely communicate with any other share holder). With a web site we can keep a monthly updated list where each share holder can add or subtract his holdings. This may allow share holders who also trade some of their Vivus stock to be included in an up to date fashion.

Anyone who wishes to help organize this movement, all help will be appreciated. I would especially appreciate it if someone who owns Vivus has some knowledge or experience in corporate/securities law or knows of someone who can help provide some basic information so that we can know for sure exactly the limitations of share holder power is regarding Vivus Incorporated.

Remember folks, currently our company has an effective product in a rapidly growing market and as of January 1st we do not have a single sales representative marketing our product in the most lucrative pharmaceutical market in the world (ie the United States).

So let's get our backs up off the wall and get the ball rolling. I'm not waiting on Leland Wilson any more. He has had more than ample time to prove himself and he has failed miserably. So onward!
