Roger, I have yet to see a suit lodged by the shorts win the day in court. And in the case of Softbank/E-trade/Yahoo triangle, one could reasonably say that E-trade needed to spend the money with someone to advertise their business (and indeed this advertising is paying off handsomely for E-trade), and who should they spend that money with if not the leader in the field, namely, Yahoo? I think that the chance of recovering from Morgan, Softbank and Yahoo a red cent for losses incurred by shorting Yahoo are one in a million.
