I have a friend who is in the exact same predicament as you. He sold his shares for a tax loss in November. He received the warrants, but didn't receive the preferreds. In trying to help him out, it was discovered that this issue has nothing to do with your broker. Putting pressure on E*trade will accomplish nothing. They can do nothing about it. Technically, the preferreds will go to the person who bought your shares (if he still held on to them). It has to do with NASDAQ rules and regulations. When KAA refiled the paperwork (due to someone else having lost it) to expedite the Ps getting sent out, the dividend date (? one of the 3 dates on the form) changed to sometime in December (vs. the original date of record). Unfortunately, the DTC never told KAA this was going to happen.

So let's give KAA some time to sort this out. He is a man of integrity and he will right any wrongs out there. CVIA has to be the most shareholder friendly company I have ever seen. Once he gets the chance, he will take care of it. Everyone just needs to be patient.
