You have to do a time and sales check. First you have to know the exact time the market order filled. If it filled within 3 minutes or so of your actually placing the order, I doubt you have a case. I have placed market orders of rapidly moving stocks and had the "preview" page show me one price, only to get filled much higher - and within a few minutes. I watched this stock and tried to get it with a limit order - one minute it said $13 3/8 and when I hit the "submit" and then checked the price it was already over 15 (in a minute or less). That's the problem with volatile stocks - they can move up points in seconds. When you get the preview page prior to your hitting the submit, that is no guarantee that the price will stay the same.

However, if it filled more than a few minutes after you placed the order, it is definitely worth raising a stink!
