No, the FCC approval is guaranteed, since NXLK is not
an incumbent (RBOC or cable company) in any market.
In fact, the FCC will like the deal, since it will
increase competition in local phone markets on a nationwide
basis, and will provide increased competition against
WCII and TGNT.

Does anyone on this thread follow NXLK carefully?
Today's move suggests NXLK may be able to offer an
entire range of service in local markets (fiber for
buildings that can be connected by fiber, wireless
for other buildings). Assuming they have or will be
able to secure long-haul facilities, they could
represent quite a juggernaut, and I am not even speaking
of leveraging McCaw's NXTL and Teledesic operations
to bundle cellular of satellite broadband wireless
services.
