Is the suing investor related to the McDonald's java woman by: Not_A_Random_Walk 1354 of 1362
Nothing unusual as far as law suits are concerned.
More than 95% of the time these kinds of suits amount to nothing.
Note: the article said: "On October 20, 1998, Datastream surprised investors by issuing a press release announcing disappointing earnings for the third quarter of 1998. The market reacted sharply to the announcement with Datastream stock falling$4-1/8 or 29%, to $10 per share. Datastream common stock had traded above $20 per share for much of the Class Period."
Actually, this statement by the lawyers is incorrect! Datastream met expectations and made a record for revenue. Earnings WERE NOT A DISAPPOINTMENT for Q3! The problem was that future earnings were cut back alittle, analysts seen no short term reasons to hold the stock, and the revenue mix was not as expected.
Also, it was noted that the stock dropped 29%. SO WHAT! It's a NASDAQ stock and much of the time when analysts downgrade and mention short term future doesn't look as rosey, the stock will drop. BIG DEAL.
The important thing is that did DSTM delibrately inflate earnings estimates? No they did not. Should we hold DSTM at fault for not being able to predict a world wide slow down? Geesh, the lawyers are even more stupid than I thought. Earnings get adjusted from time to time: either up or down. Much of the time these adjustments come from the analysts, not the company. The analysts are in close contact with the company, much closer than we are.
Too bad for the investor that helped file this suit! My violin plays for that poor pitiful excuse of an investor! I wonder if the investor that helped file the suit against DSTM is related to that woman who sued McDonalds for spilling hot coffee on her crotch? These two stories are related in that we alone should be responsible for our mistakes and not blame the world for them.
Actually, I had DSTM as high as 13.5 and I seen it go to 8 5/8 in almost a two week period. Perhaps I should sue DSTM because that is much more than a 29% decrease!!
My words for the investor: boo-who, boo-who,who,who you cry baby! If you can not take the ups and downs of small cap NASDAQ investments - DON'T INVEST IN THEM YOU IDIOT!
