I understand this to be tongue-in-cheek. If not, please advise what provision of the antitrust laws suggests that the DOJ could not oppose Intel acquiring AMD. In the past, the FTC has opposed a takeover resulting in a firm's failure when no other buyer could be found. And, while the "failing firm" defense is supposed to make the DOJ look more favorably on a merger they would otherwise oppose, I don't believe it mandates that they allow it.
