Oops, I need to clarify something. My purchase of DSTM occurred on 7/16/98, the morning after a quarterly conference call. But this was the quarter prior to the 10/20/98 report mentioned in the lawsuit.

I have no comments on the basis of the suit. I am simply noting my displeasure with what I heard in the 7/15/98 conference call versus what was released on 7/16/98 (the dates may not be exact but are close--I am unable to access these dated press releases on Yahoo).

I apologize for not being specific about dates in my posts. I assumed (incorrectly) that the quarter mentioned in the lawsuit was the one I had felt was not handled well. But it was not the same quarter, although the lawsuit does cover the July 1998 reporting period.

Based on the information included in your post, I do not see evidence of an "October surprise", though I am not comfortable with July.

The bottom line for me, though, is this: While I felt that the July 98 call was not well handled, I also did NOT feel that DSTM management was withholding information purposefully. My feeling at the time was that they might have had a change of heart following the call regarding their formal report, what to write off, etc.

But this is simply my best guess. It is also possible that I missed something in the conference call, though I don't think so. I didn't listen to the 10/20/98 conference call (3 months later) since I felt that listening to the prior one did me more harm than good.

I continue to like DSTM as a company and have increased my holdings during the recent drops.

Did anybody else feel surprised last July?
