There is a second part to the founders solution. The various branches of government should not be allowed to set themselves up as petty kingdoms which exploit those not in power. The more violation, the more pressure there is for unified central rules, which steps on the local authority. If the conservatives spent half as much effort on curbing the excesses of local majority dictatorships as they do on trying to isolate themselves I think accommodation on local rule would be accomplished.
