Yes, Replay and Tivo use the Sony encoder. And yes it's a scary thing is it's in a Sub $1000 box, meaning the Sony encoder is cheap, or subsidized... Replay & Tivo just couldn't see adding in the additonal cost of a FPGA to make it work with Cube. Two very similar products that are chock full of very similar technology from two different companies and there are no infringment suits? Sony said don't do it...
