The Kyl bill will probably resurface but there is growing opposition. Even DOJ has complained it will be almost impossible to enforce. The net is a world wide phenomena and banning, restricting or regulating by any single government is an unsure proposition. Other countries have entirely different views about gaming and entertainment on the net. It is unlikely that anything like Kyl will ever fly in the European community and many other countries view it as good business or tolerate it.

Will Uncle Sam really want to put Joe sixpack in the slammer for betting a few bucks on the Superbowl? Can Uncle Sam arrest the sportsbook taking the bet in Antigua where such activity is legal? Gaming is pervasive already, even without the net; local, state and federal police have better things to do with their time. Can Uncle Sam shut down ISP's that provide the links? The whole idea sounds like a regulatory and enforcement nightmare.

Eventually it will make more sense to have a respected licensing authority give a seal of approval to sites that are legitimate, fair, and work out methods to answer reasonable concerns raised in the Kyl bill. Perhaps existing operators should band together and regulate themselves just as many other associations do.
