Please be advised that the Match-E-Be-Nash-She-Wish Band Band of Pottawatomi Indians (a.k.a. Gun Lake Band) has enacted the following resolution on January 21, 1999:

A RESOLUTION TO CLARIFY THAT THE MATCH-E-BE-NASH-SHE-WISH BAND HAS NO ON-GOING BUSINESS RELATIONSHIP WITH SUNGOLD GAMING

WHEREAS, the Match-E-Be-Nash-She-Wish Band of Pottawatomi Indians of Michigan (hereinafter the "Band")is a federally recognized Indian Tribe whose federal recognition was confirmed by the United States Assistant Secretary of the Interior on October 14, 1998, and published in the Federal Register on October 23, 1998, and

WHEREAS, the membership of te Match-E-Be-Nash-She-Whish Band of Pottawatomi Indians of Michigan has elected the Match-E-Be-Nash-She-Wish Tribal Council and delegated that body the authority to govern the Band's political, economic and legal affairs,and

WHEREAS, the Tribe had an unenforceable agreement with Sungold Gaming International (Sungold or Sungold Gaming) to finance and manage certain future tribal gaming ventures, and

WHEREAS, the agreement is unenforceable as it was never approved by the Chairman of the National Indian Gaming Commission as is required by 25 U.S.C. Section 2711, and

WHEREAS, Sungold Gaming International failed to live up to its obligations under that agreement, and

WHEREAS, on October 30, 1998 the Band's attorneys notified Sungold Gaming that because Sungold had failed to adhere to its obligations of the aforementioned agreement the Band had been forced to seek other sources of financial assistance, and

WHEREAS, on November 17, 1998 the aforementioned tribal attorneys sent Sungold Gaming International a second letter offering to negotiate a settlement of all matters relating to the Band's prior business dealings with Sungold Gaming, and

WHEREAS, despite Sungold's receipt of those two letters and its numerous conversations with the Band and its representatives, Sungold has continued to mislead its stockholders and the public by giving them the impression that it has an on-going agreement with the Band pursuant to which it will finance and manage the Band's future gaming ventures, and

WHEREAS, the Band has advised Sungold that it has no intention of doing business with Sungold in the future,

THEREFORE BE IT RESOLVED, that the Match-E-Be-Nash-She-Wish Tribal Council, acting on behalf of the Match-E-Be-Nash-She-Wish Band of Pottawatomi Indians of Michigan, hereby gives notice to the public that it has terminated all business relationships with Sungold Gaming International effective November 30, 1998 and orders Sungold Gaming International to cease and desist misrepresenting its relationship with the Band.

This resolution was enacted at a properly called meeting of the Match-E-Be-Nash-She-Wish Tribal Council held on 1/21/1999, by a vote of 5 in favor, 0 opposed and 0 abstentions.
