To clarify, the FCC limitation will not affect the end user modem as it transmits into an analog line and is limited to the 28.8/33kbps. The FCC limitation is the signal strength that server equipment that connects to the digital network can put out. The testing that USR did showed that 53kbps was the max without exceeding the limit. The limit was set during the time we were racing thru the net with 2.4kbps. As far as I know, USR is currently asking for a waiver until the limit can be examined. If the waiver has not been approved before the distribution of x2, the server side will be limited by software to meet the limitation and the upgrade at this time will be free when the approval is obtained.

When the v.42 is added the transfer download rate can be reached at speeds of somewhere in the neighborhood of 200+kbps.
