Judge Holloway clearly disagreed. The Senate gets to decide if Monica's testimony is to be used at trial. They do not get to determine what occurs outside the chamber. Besides, if Monica were to testify, she would be subject to cross- examination. Alan Dershowitz has decried the lack of cross- examination in the past, saying that the reliance on grand jury transcripts is inherently unfair. Thus, it seems to me that it would be fairest to let Monica et al. testify.
