A lawsuit such as the one just referenced by you will have the inevitable inflammatory effect of scaring the faint hearted among us.
The reality is that this suit is equally if not even moreso spurious to the one which was filed two weeks ago. Think about what it is that the Plaintiffs would have to prove beyond a preponderance of the evidence. They would have to show that JT did not enter into this effort with any intent of actually accomplishing a buy-in/buy-out of abtx. Imagine the witnesses who would appear on behalf of the company such as the CEOs & CFOs of all the players who passed through Henderson. Imagine the voluminous exhibits which the company would be able to lug in as evidence of the extent of work that was done by ABTX in order to make their presentations. Imagine the testimony that could be presented by the ML/DB people as to what efforts had been expended in this effort. Now I'm only a small town lawyer with a secretary and a pc (I'm supposed to get a fax soon) but I would be glad to take on the big boys on this case and I would look forward to the award of counsel fees to me when this piece of crap was dismissed.
