Avoiding Trademark Infringement

Trademarks (or brand names) are commercial indicators of source. They may be words, logos or other symbols that tell consumers that goods come from, or are sponsored by, a particular company. They may be sounds, three dimensional symbols, such as the well-known "golden
arches", colors -- or even scents! [Service marks, that indicate the source of services, and other kinds of marks need not be considered here.] A firm should be very cautious in using a word or slogan that another firm has indicated as its mark by a superscripted "r" (r-in-a-circle) to indicate ownership of a federally registered mark or a superscripted "TM" to indicate ownership of a mark that is not federally registered.
