Courthouse update.
I called the federal courthouse today in ABQ and they still don't have anything that has been filed since some motion was filed back on Jan 6th. The last decision was made on Oct 30, so the 90 days would put us at tomorrow or Monday, (not sure how court time works),
If nothing has been filed by Monday, I'm going to talk to a friend of mine that is a lawyer, ( everybody knows one, don't they) and find out what he thinks the scoop is.
The judge wrote this in his decision,
The court now lifts its stay of discovery and authorizes Plaintiff to engage in this limited discovery so as to permit it to respond to the motion for summary judgement. Discovery must be completed and the response to the motion for summary judgement served within ninety(90) days from the receipt of the court's order.
so there it is, more legal mumbo jumbo for us to decipher, LOL
SO, if we don't settle in a day or two, then we will have to file with the Judge the reasons why he shouldn't dismiss the case and allow us to take the case to court and I guess set a date, atleast then we will have a time idea.
So basically AOL settles now, or takes their chances once again with the Judge on the motion for summary judgement and if he finally dismisses it, then only our motion for damages or whatever is left and we can set a court date.
