WWS probably wants to restrict DIRECT export of uranium by way of country instead of holding foreign mining company's liable. Kazakhstan exports $250 million in uranium a year so if the ruling works a settlement could come.
What a previous company did- Trans World Group (TWG), a British-mining company, filed a lawsuit (in the Netherlands) because of unjust cancellation to mining contracts in Kazakhstan. The lawsuit asked the courts to restrict all export of ferroalloy material coming from any Kazakhstani port. The Dutch court ruled in favour of Trans World Group, to confiscate any Kazakhstani cargo that contained ferroalloys for three months (January 1, 1998 until March 31, 1998). Nevertheless, on March 6 1998, the appeals court cancelled the original ruling. The judge cited that the decision would allow the parties to settle the dispute themselves. Kazakhstan Weekly News 16 March 1998.
TWG is still seeking damages…What was interesting about the lawsuit was it only took a couple of weeks from filing to get the restriction in place to block all Kazakhstans ferroally exports.
Another court case, about time frame- Placer Dome settled with the Kazakhstan government after about one year and a half of being in the courts, of course the case was about a money deposit for a mine, a little different in circumstances.
Does anyone know what the title of the trial is in Washington, D.C.? If so, could you please post it.
Thanks. |
