Whether or not they settle. Any purchasing of BNEZ by AOL employees
privy to negotiations or any purchasing by the company would be
nothing short of an SEC violation of the highest order. We all
know that the stock price is going to move up soon. I would guess
that with a 35million share pool and $10million revenues in 1999
that we might see $5 by the end of the year. Who knows? Perhaps
closer to $10. Despite that likelihood, AOL could not get into
it now....unless they settle and benefit from PMA. That is the
only win/win situation. An appeal or a verdict would reveal
chinks in AOL's armor regarding vulnerability to lawsuits. They
have successfully defended other cases and each one raises the stakes for the next inevitable blunder that one would expect from a constantly changing database. This trial, however, is not the
result of the blunder in stock price itself. There would not be
any lawsuit if that was the case. This trial is about how a service
provider acts to identify and correct errors. Numerous emails between companies and an almost invisible correction process that failed to inform consumers is at the heart of this case and many that should follow. I believe that the judge is going to punish AOL and set a precedent. The internet is becoming the world's primary means of communication and the same political correctness that has altered the way we speak and behave in the workplace will find its way into this essential medium. And AOL is not going to let the judge come to this
decision. They WILL settle and promote AOL through their online shopping subsidiaries and take a profit from the proceeds. No guilt/No disclosure for AOL with some profit to compensate for legal fees. Exposure through a superpower much larger and more relevant than sparco/egghead/anything pc, and sales for PMA with recovery of legal fees...Win/Win
