Ray, it would not be as hostile takeover of Barrick or 40% of Barrick. It would be termination of contract. Barrick have already stated what they think their share is worth and not a penny more. In my opinion, if the contract were terminated at this point in time by ARP, Barrick might sue for damages but, if I were the judge, I would hold them to their price evaluation.
In the civil world, there is a stream of law which argues that the law should support fairness, natural justice and moral values.
Barrick was invited to the party on ARP property. Private and confidential information was shared with them on the basis of the JV. The information shared with Barrick for purposes of advancing the project was IMO used in an inappropriate manner and led to the pre-emptive, coercive and hostile offer in an attempt to take advantage of ARP and their shareholders.
I'm sure that there are lots of young lawyers out there, who have not made their fortune yet, who could come up with dozens of arguements.
To be or not to be, that is the question.
Hang on to your shares folks. Let the drill do the talking for a while. I don't think the price will be going down. And remember there is a lot of very prospective ARP property in the El Indio Belt just begging to be explored. You just do not find two mountains side by side that are full of gold and silver wiithout there being a few more in the area. THat is what Barrick's calculator tells them.
