To B.A. Marlow and SI AXC'er's:
My name is Dave Gardy. I am Chairman and CEO of TV onthe WEB. Although I don't frequent the threads very often, I felt compelled to let you know that I first learned of the AMRE attempt to replicate our TV onthe WEB home page on their site when I happened to read the B.A. Marlow "plot thickens" posting on Saturday morning. Later, Lisa Amore, our P.R. director informed me that out of the hundreds of e-mails we received this week, there were several investor inquiries regarding our relationship with AMRE...inquiries she was confused by until I mentioned what I learned from the SI board. After alerting certain investigative agencies here near Washington D.C., I was able to locate and contact the Chairman/CEO of this firm in Vancouver yesterday afternoon. Although he apologized profusely for failing to obtain our permission to display our trademark and proprietary channel icons, I insisted that he cease and desist with such acivity and remove our graphics and video links from his home page as soon as possible. I indicated to him that I would be consulting with my corporate counsel and following up with correspondence regarding his unauthorized use of our site graphics since 1/28, the date that we have been able to ascertain that he incorporated our graphics on his web page. As you know the site is no longer using our trademark or channel icons. I am especially grateful to B.A Marlow for his diligence in uncovering this unauthorized use of TV onthe WEB content and to all AXC'ers for their response to this matter and interest in TV onthe WEB. When I do check into this thread, I find the postings insightful, pro-active and pertinent.(Yes, CEO's frequently view these postings, we just can't always participate). Thank-you again for the integral role you've all played in resolving this issue. Its been a great week and I think we all have much more to look forward to. Dave Gardy, Chairman and CEO, TV onthe WEB, Inc.
