Sorry, but I thought you were focusing on the lawsuits and whether they justified taking a negative view of the stock. Judges will focus on legal issues, too. You really are misinterpreting things.

Without the realistic threat of treble damages and attorneys' fees, these lawsuits don't pose any real financial threat to AOL and can be delayed for years until such time as AOL decides to dispose of them. These private attorneys will be happy to get bought off for a pittance. The AG's screwed them.

I suspect you may not have made a lot of money in your career practicing law. Over the years, I have. Also, I'm reasonably proud to have made some correct judgments about the movement of stock prices when non-lawyers have made panicky assessments about the effect of lawsuits on stock prices. Although there is some realistic and hardheaded analysis about AOL's weaknesses on this board, you seem to be taking this personally.

There are clearly some short term problems here, or the stock would not be priced in the high 30's. In my best judgment, I think there is a lot of money to be made going long on this one. Wall Street is going to pave the way for a successful secondary offering. Fortified with that cash, AOL will have the breathing room to continue with its strategic plan. I suspect you don't have real money invested in this, one way or the other. But you might consider putting your nickels and dimes into a temporary long position, even if you do not want to be a long term investor. Shorts are finally coming to the day of reckoning here and the real drama will be in seeing how they try to extricate themselves.
