Some of the other D.D. threads have been posting questions about where the properties are located and how much property they actually control. So, if I can leave the chemistry and biology for a while I will attempt to address the mining issue of land status.

I am not sure but most of the desert dirts seem to be located in areas that are on public lands managed by the Bureau of Land Management. Any person or company can stake claims on this land.
If it is BLM land it can't be leased, only staked.

A placer claim must be no more than 20 acres. A lode (hard rock) claim can be no more than 20.66 acres. There is no limit on how many claims can be held. When a claim is staked it must be marked with several monuments ( posts). These posts must be placed on the corners and roughly surveyed. The claims must be filed at the county courthouse and with the BLM. The filer must also pay a $100 per claim fee to the BLM and also pay this same fee annualy.

If a private party owns the mineral rights, then the land can be leased.
I am not familiar with state land in Arizona yet but some states allow land to be staked or leased.

Any person can verify if the land is claimed by checking with the BLM or the county in which it is located.

As time and resources allow, I will check into the status of the D.D. companies and their land holdings.
