John, It seems bad charma that FTEL is once again involved in a deal where one of the companies it deals with appears to be getting into deep water over using flat rate service.

"LA JOLLA, Calif., Feb. 2 /PRNewswire/ -- USA Talks.com, Inc. (OTC Bulletin Board: USAT - news) today announced the termination of all marketing relationships with TrendMark International, Inc., of Memphis, TN. USA Talks has requested TrendMark terminate all its marketing efforts and activities to sell the USA Talks' flat rate, telephone to telephone, internet based long distance service.

If you remember, the law suit against FTEL by AT&T was for using their telco lines using a flat rate in association with another company. They argued that they were innocent because it was a company they were associated with that illegally used AT&T lines for profit.

FTEL ended up settling with AT&T out of court in a settlement agreement. Do you know the terms of that settlement? I doubt that anyone else at this point knows either.

My whole point is like history going to repeat itself?

FNET is USAT point of presence on the Internet just like they were with their previous flat rate provider.
