I have a semantic niggle here - but one which changes the complexion of your post. Punishment is reserved as a consequence of an act. Punishment follows a crime - it never precedes it. "Punishment" for an act not performed (in this case an act potentially performed?) is contradiction and injustice. It places presumption of guilt into the same categpry as legal establishment of guilt.
If someone is likely to do something bad but has not done it - then the prudent course is prevention, not punishment. Imo this isn't PC word doctoring, but real protection against creeping barbarism. Shall we be punished for Unauthorized States of Mind?
