Maybe the lawsuit will elevate the decision making to the CEO level-
But a contract of this size should have an account team capable of elevating such a sizable issue to the CEO level without firing an atomic weapon. If EDS screwed up on having a large scope of work not covered with a contract provision then it should eat the hit if the customer CEO does not agree to compensate. If EDS is covered and the CEO does not agree to compensate and is a real SOB, then a lawsuit is deserved. I would really like to know which situation applies in this case.
