Steven - you could be right about direct dealing - but please share with the thread your thoughts on the disclosure aspects of this - namely: Barrick has 9.9% now - does it not have to disclose any incremental increases in its position? Someone posted earlier that it would have to disclose at 12% and every additional 2% thereafter.

The only thing I can think of is this - so long as there is an open offer on the table Barrick may not have to disclose the number of shares tendered or tendered conditionally. Does anyone here have any info on this?? This may also apply to another form of conditional acceptance - in other words there may be an informal understanding with the TD group and NEM - that they will tender too if Barrcik obtains x % - or something to this effect eg if the offer expires at the deadline without another offer in place.

Otherwise ABX is just the patsy with the floor bid on the table and the stock always trading slightly higher. dd
