To break Microsoft , it must be under the following two reasons, i.e " Increase the competition" & " Benefit the consumers"

It was mentioned that the bad work done by MSFT will a factor in the appeals court really makes its rulings(assuming a DOJ win).

The two points you listed will be just based upon the economic witnesses for the most part. This issue can't be decided based upon how the witnesses reacted, how the video was a flop etc. These are fundamental questions which any appeals court can overrule. Judge Jackson can't say that he finds the government economic witness more credible---based upon what(less nervous maybe). That is why I believe the decision is going to boil down to 3 majors points.
-the 2 listed above-benefit to consumers.
-does MSFT have a O/S monopoly.

I think MSFT might win at some level on either of these points. Maybe someone can clarify this point---> Can Jackson still issue
a preliminary injunction of some sort? If he can, it won't be very tough one on MSFT, IMHO.

BTW-I think MSFT just want this to be over. Too much bad PR.
