My firm, Bernstein Litowitz Berger & Grossmann LLP, has been prosecuting a class action against E*Trade since November 1997. The complaint alleges that E*Trade's advertisements misrepresented the fact that customers would have 24 hour access to their accounts and that trades would typically be executed within seconds when, in fact, E*Trade's systems are often unavailable and trades often take longer than a few seconds.
Plaintiffs filed their motion for class certification last week. The class period runs from September 1996 through the present. If the class is certified, the interests of all those people who had accounts at E*Trade since September 1996 will be protected so there is no need for people to file new class action lawsuits.
