Do you think MSFT will lose? Yes. If they somehow managed to win, it would be so surprising to anyone who has followed the trial that today's 5 1/4 runup on MSFT would look like a tiny bump compared to the huge jump it would take. They're highly unlikely to just "pay the fine" for a few reasons: 1) While nobody knows what "relief" DOJ would seek, it's likely to be more significant than just a fine 2) agreeing to any penalty in this phase of the case would be to admit to the factual findings which would put MSFT in a tremendous bind. What's most likely is an appeal and "business as usual".
