PCNTF - Legal Proceedings? In January 1999, the Company was informed that two US-based companies are alleging that each of them owns certain rights in the name ‘Pacific Internet' and that the Company's use of the name ‘Pacific Internet' in the United States infringes upon the complaining companies' right in such name. As the Company does not regularly conduct business in the United States, such allegations appear to relate to the conduct of the Offering and the anticipated trading of the Shares on the NASDAQ Stock Markets' National Market. The Company has reviewed the nature of the infringement claims and the relevant facts, and believes that there has been no infringement by the Company of the complaining companies' rights. Nevertheless, the Company can give no assurance that the complaining companies will not take legal action on the basis of their alleged infringement claims or that any such action, if commenced, will not result in a judgement or other relief that could have an adverse effect on the Company or the trading price of its shares.
