Open Letter to International Telecommunications Union on Third Generation Intellectual Property Rights (IPR) On IMT 2000 RTTs

China Telecom recently sponsored an Operators workshop on "Harmonized Global 3G (G3G)" in Beijing, China from January 14-15, 1998. The
operators listed below agreed to issue the following statement to ITU:

Given that Intellectual Property enables existing wireless networks and products to provide benefits to customers and
will be required for third generation systems as well, the undersigned wireless operators request that IPR holders,
suppliers and manufactures take the following four steps to increase the global market potential for IMT-2000 services:

1. Apply the following IPR principles:

IPR should be freely exchanged between manufacturers, based upon license and/or cross license
agreements as appropriate which are negotiated on fair, reasonable and non-discriminatory terms
and conditions.

The total cost of IPR shall be kept to a minimum to create the maximum global demand and
acceptance of third generation services and products.

Third generation suppliers and manufacturers should seek out other IPR holders and put license
and/or cross license agreements in place as soon as possible.

Obtaining the relevant IPR licenses and/or cross licenses is the responsibility of suppliers and
manufacturers and should be conducted privately between the IPR holders and the
supplier/manufacturer licensee.

IPR should not be used by any company or group of companies to:

- Delay the introduction of IMT-2000 systems and services

- Withhold the use of technology from a harmonized international standard

- Restrict the import or export of third generation equipment to or from any country
(consistent with international trade agreements)

- Increase the cost of third generation systems, services and products, beyond historical
reasonable and customary levels

- Stifle innovation and the free flow of ideas among companies engaged in developing global
IMT-2000 specifications.

Continued public IPR debate and disputes are damaging to the global wireless industry and should
be resolved.

2. Bring IPR portfolios in line with the above guiding principles

3. Obtain license and/or cross licenses for each relevant third generation IPR Holders as soon as practical.

4. In addition, together with the efforts to solve the IPR issue, it is important to facilitate the standardization
activities at ITU.
