moby, I don't know about illegal, but it may be. You did short naked. I did that once at Waterhouse with an accidental PSFT double sell. I don't think it's a big deal, as long as you buy before settlement. If it were me I'd clear it as soon as possible, especially if I had a profit. I don't think you'll have the luxury of holding it through if the market were to turn against you for some reason.

Sometimes when I run into a really ripe short that I can't borrow, I'm tempted to 'accidently' sell it. I never do, because it adds in risk factors I don't want to deal with, and it's not honest. I mean to do it on purpose.
