The respondent gets to determine whether or not there is the potential for criminal liability, and therefore a claim to 5th amendment immunity is almost always deferred to ( the notable exception being immunization). Even a case that MIGHT be brought is grounds. I'm sure if we thought about it, we could come up with charges surrounding the relevant items.
