The rules governing dealing with E-trade are simple. If they screw you over and you can't get any satisfaction from a supervisor via phone then you must write them a formal letter explaining your side of the story (keep a copy). They will respond in 2 weeks with their own letter basically either offering you less than what you thought was fair or nothing. You then can send a copy of both letters to the NASD in New York along with a claim stating what damages you are seeking. For about $150.00 in filing fees(you will ask for reimbersement from E-trade as part of your claim) they will review your claim. Claims under 10k are settled quickly by one arbitrator without a hearing if you chose. If you want a hearing it costs more and then they will hold an in person hearing. I still haven't filed my claim (mostly out of procrastination and hoping that E-trade would mail me my phone call tape transcripts that are now 3 1/2 months overdue) but hope to write it up and mail it out by tomorrow.
