Government's Lawyer Raises More Questions About Microsoft Demonstration

Late in the day, Boies used a Microsoft videotape shown earlier in the trial to demonstrate conflicts in Microsoft's defense.

On one hand, Microsoft is trying to show that integrating a Web browser with Windows is a great benefit to users because it saves them the time and difficulty of acquiring a browser on their own.

A Federal appeals court ruling last year said that bundling the browser with Windows was justified if users benefited.

On the other hand, Microsoft is also trying to show that downloading an alternative browser is fast and painless, to defang the Government's charge that bundling the browser is anticompetitive.

In the earlier tape, a Microsoft employee, while extolling the virtues of integration as a benefit to consumers, describes some of the hassles of installing another browser and adds that these difficulties do not "take into account the set-up time, which for a large number of users is cumbersome and not straightforward."

"I do agree it's easier if you get it on your system," Chase acknowledged.


Still haven't seen the government's response to Devlin, though.
