WHY THIS CASE IS OVER...AND MSFT WINS.

If you think about it...the gov't MUST acknowledge that this market moves very very fast, and that stepping on it could kill\harm it.

1: AOL and Netscape together means NOTHING for this case. Can't believe the stupid press even refers to this. Who cares.

2: Gov't case only shows they are a competitive blood thirsty company. Employees make comments about 'killing' competition. GOOD! That shows they are normal. You can't win a case like THIS by showing email that shows people are trying to 'kill' competitors...(or even faked videos), and where is the smoking gun with a msft employee stating...."hey bill...I did what you told me and wrote that line of code that crashes the Netscape software when it opens any web site running NT". It doesn't exist.

3: 8 years ago MSFT was laughed at by the ENTIRE industry for it's windows product. Some were late to adopt it and got killed. WP, Novell, Lotus etc. They loose.

CONCLUSION AND WHY MSFT WILL WIN
TODAY, only 8 years after WIN 2, (which sucked big time), MSFT makes a truck load of cash. So what? The issue really is that with the IBM/Compaq, Oracle, Red Hat Linux announcements, this market is changing WHILE THE TRIAL IS ON.

In the summary wrap up, MSFT should state the following.

"Good morning Mr. Judge. In closing let's sum up the market changes since you first sat in this chair to listen to this case only a few short weeks ago. AOL this, Netscape that...x billion this, x-billion that...Linux This and Linux that. NOW MR JUDGE...LET ME HAVE YOU PONDER THIS ONE IF I MAY, (Cough cough). [silence in the room]

Mr Judge...How many emails do you think were passed around between IBM, Red Hat, Novell, AOL, Compaq, Oracle and others that stated, "What we'll do is support Linux, and we'll 'kill' MSFT in the marketplace. It will take years, but we'll win...but we must keep this quiet as we do not want to give MSFT the ability to use these major ideas in their DOJ case?"

Would there be at least ONE of the comments?

Yes...and THAT WOULD BE THE DOJ's smoking gun. MSFT will win this.

The only way they will loose this case is if the MSFT lawyers are actually as bad as they look to the average casual listener.
