What is the judge going to find?

1. There are no reasonable substitutes for Windows in the desktop OS market.
2. There are significant barriers to entry in the desktop OS market.
3. Among the barriers to entry in the relevant market are the "network effects" that make it difficult for a competitor to enter the market because of the breadth of applications available for the OS.
4. A separate market developed for a product called a "web browser".
5. Microsoft engaged in predatory pricing to gain share in the web browser market.
6. Microsoft engaged in "tying" to extend its OS monopoly to the market for web browsers.

Far from being mere theatrics, it looks to me like Boies hones in on one or more of those issues when he challenges the testimony of a witness. The MS memos he presents as exhibits often reinforce items 4,5, or 6. It sure does look to me like he's built a good case and that he is maintaining it with each MS defense witness.

But, in the end... I'll keep my MS stock. I do believe that they should lose and will lose this case, but that there is enough hidden value in the company that it will remain a great investment no matter what happens in the trial.
