Very simple. The law states you have to be a licensed professional to recommend buying or selling stocks to the public. Merrill Lynch has licensed professionals. You are not a licensed professional. The internet is public. Therefore if you recommend that people buy or sell, you are breaking the law.

However, there is no law against stating what you like (your picks) and what you are buying.
